BETWEEN:
BRISBANE WOMEN’S HOCKEY ASSOCIATION (“BWHA”)
and
[Manager Name] (“Manager”)

RECITALS:
The Manager has been selected by BWHA to manage the team described in the Schedule, participating in the Event during the dates specified in the Schedule.

AGREEMENT

1. MANAGER’S OBLIGATIONS

Commencing on the Commencement Date, the Manager agrees to:

1.1 Team Responsibility:

  • Oversee the team, particularly during tours and competitions.
  • Support the Team Coach.
  • Ensure compliance with all match and competition rules.
  • Ensure team members adhere to BWHA’s policies and code of conduct.
  • Ensure team members’ conduct maintains the reputation of the team and BWHA.
  • Refrain from recruiting players to other clubs or managing another hockey team without BWHA’s written consent.

1.2 Team Support & Communication:

  • Attend team events, competitions, and meetings with BWHA as required.
  • Report any material issues regarding the team to BWHA promptly.
  • Provide guidance and support to team members and ensure their conduct is appropriate.
  • Maintain confidentiality regarding team member health and performance data.

1.3 Public Representation:

  • Do not speak to the media without prior written approval from BWHA. Any media engagement must align with BWHA’s views and policies.
  • Refrain from promoting, supplying, or condoning drugs or stimulants to players unless prescribed and not on prohibited lists.

1.4 Disciplinary Matters:

  • Recommend disciplinary actions to BWHA for players not adhering to team policies.
  • Be available for regular updates and reports to BWHA.

2. SPONSORSHIP

2.1 The Manager acknowledges and agrees:

  • To cooperate with BWHA and its sponsors to maximize promotional benefits.
  • To avoid involvement in competing sponsorships without BWHA’s prior written approval.

3. MEDIA

3.1 The Manager agrees to participate in media coverage, including filming, photography, or recording, as authorized by BWHA.

4. CONFIDENTIALITY

4.1 The Manager agrees not to disclose BWHA’s confidential information, including trade secrets and team member data, without prior written consent.
4.2 The Manager will only share confidential health information about players with the Team Coach or BWHA.

5. DEFAULT AND TERMINATION

5.1 BWHA may terminate this Agreement immediately if the Manager:

  • Fails to fulfill duties or adhere to BWHA policies.
  • Commits criminal acts or misconduct that may damage the team’s or BWHA’s reputation.
  • Is involved in performance-enhancing drugs or stimulants.

5.2 If the Manager is unable to continue due to illness or incapacity, BWHA may terminate this Agreement.
5.3 Upon termination, the Manager or their estate will receive any owed remuneration up to the termination date.
5.4 The Manager will not induce team members or staff to breach their contracts with BWHA after termination.

6. RELEASE

6.1 BWHA is not liable for any loss, injury, or damage to the Manager arising from participation in hockey events or activities, including negligence, except as mandated by the Competition & Consumer Act 2010.

7. EXPENSES

7.1 The Manager agrees to reimburse BWHA for any expenses incurred on the Manager’s behalf, upon demand.

8. INDEMNITY

8.1 The Manager agrees to indemnify BWHA for any loss, claim, or damage arising from their actions, including illness or injury while fulfilling duties under this Agreement.

9. DISCIPLINE

9.1 BWHA may take disciplinary action if the Manager breaches the Agreement, including suspension, dismissal, or exclusion from future teams.

10. BWHA’S LIABILITY

10.1 BWHA is not responsible for any medical expenses or injuries incurred by the Manager during hockey activities, except as specified by the Competition & Consumer Act 2010.
10.2 The Manager acknowledges the inherent risks of injury associated with hockey and accepts these risks.

11. TERM

11.1 This Agreement is effective from the Manager’s appointment date and expires 30 days after the conclusion of the Event outlined in the Schedule.

12. GOVERNING LAW

12.1 This Agreement is governed by the laws of Queensland, Australia, and any disputes will be subject to the jurisdiction of Queensland courts.
